Before You Begin: Terms of Use
Your organization agreed to these terms with Teknikos when it bought your seat, and they come with it. They are shown to you here so that you have read them; before you can access the Platform or the Curriculum, you must agree to these Terms of Use. By clicking to accept them, and by accessing the Platform, you agree to be bound by these Terms of Use, which creates a direct agreement between you and Teknikos, Inc. in consideration for the access Teknikos gives you. You confirm that you are at least eighteen (18) years old and that you use the Platform in the course of your work for the organization that holds your seat, and not as a consumer.
Everything in this course is unpublished, confidential material owned by Teknikos, Inc. and protected by copyright, trade secret, and other intellectual property law. That covers the chapters, tables, diagrams, frameworks, practice material and cases, answer keys, check and exam content, and, where your course has one, the capstone scenarios. The check and exam content, the answer keys, and the capstone scenarios are also Teknikos trade secrets: they are not published or disclosed outside a limited group who needs them to run this program, and their value to Teknikos depends on staying that way. The Teknikos Hybrid AI Method™ and its frameworks are Teknikos intellectual property, including Teknikos trade secrets, and Teknikos owns all right, title, and interest in them.
Your enrollment grants you a personal, non-transferable license to the platform and curriculum content for your own learning and your own practice, for as long as your seat is current. It grants nothing beyond that. Your credential is separate: it records the curriculum release you certified against, the date, and the date it runs through. The certificate stays yours permanently as a record of what you did, unless the pass behind it was obtained by fraud or academic dishonesty, in which case it is void under the Certification Policy. The certification behind it is current for twelve (12) months from the pass and is maintained by recertifying; from its anniversary it is no longer current, even during the grace period the Certification Policy allows for recertifying. Do not describe yourself as currently certified while your certification is not current, lapsed, suspended, or revoked, or on a later release than the certificate names; the Certification Policy sets out the rest. Read these terms when the platform presents them at sign-in. Acknowledging them records that you have read them, and the platform opens when you do.
What you may do
- Read the material and work through it. Take notes in your own words and keep them.
- Describe yourself as certified, and use the certificate and any badge Teknikos issues to you, in the way and for the period the Certification Policy permits. You may not otherwise use Teknikos’ names, marks, or logos.
- Use what you learn in your professional work, at the level your course teaches: in your conversations and on your engagements, with your own customers, inside your own organization. The discipline you learn here is yours to practice, and the credential exists so that you will. Apart from teaching, delivering, or facilitating the Method, nothing in these terms limits what you do with what you know.
The material itself is restricted: the text, the tables, the diagrams, the cases, the scenarios, and all materials within this certification program, as they are written.
What you may not do
You will not do anything that causes the confidential information included in this curriculum to be shared with any person, system outside of your license to access the platform, or entity without Teknikos’s prior written permission. You may not do any of the following:
Reproduction. Copying, downloading, screenshotting, transcribing, printing, exporting, or re-hosting any part of the course, including the chapters, the practice cases, the answer keys, the capstone scenario you are assigned, and the materials in the governed space. Assistive technology that presents the material to you while you use it, whether as speech, braille, magnified or restyled text, or captions, is not reproduction. Nor is an accessible copy that Teknikos provides to you as an adjustment, which you use under these same terms.
Distribution. Sharing, forwarding, or posting the material anywhere, or giving anyone access through your account. Access is granted to a person. It does not run to your colleagues, your employer’s shared drives, a customer, or a successor in your role.
Commercial use. Teaching, delivering, reselling, licensing, or building an offering on this material, whether or not money changes hands. Your credential certifies that you apply what your course teaches; it carries no right to teach the Method, to facilitate a session, or to deliver any Teknikos program.
Derivative work. Adapting, translating, restructuring, or folding this material into your own courseware, methodology, sales collateral, templates, or product documentation.
AI systems. Entering any part of this material into an AI assistant, chatbot, model, agent, or automated tool. Assistive technology you use as described under “Assistive technology” below is not covered by this restriction.
AI tools and this material
Material entered into an AI system leaves the space that governs it. It lands in a third party’s infrastructure under that vendor’s terms, where Teknikos cannot control who reads it, how long it is retained, or whether it trains a model. Supplying any material from the platform, the curriculum, or any of the related materials provided by Teknikos is a disclosure of Teknikos’ confidential information and protected intellectual property. This prohibition against disclosure into any AI system holds whatever the purpose and quantity disclosed to an AI system: including, but not limited to, summarizing a chapter, generating flashcards or practice questions, asking a model to explain a framework, translating a passage, drafting an assignment, or answering a check or exam item. There is no permitted quantity and no exception for a short excerpt.
This prohibition applies to every AI system that receives text you input into it, including the AI assistant built into a browser, an IDE, a note-taking app, or an office suite. Where you are unsure whether a tool sends your content to an AI system, treat it as one, unless it is assistive technology, in which case the next paragraphs apply. You are not in breach of this restriction if a tool you use processes material through an AI feature that you did not invoke and could not reasonably have known about, provided you stop using that feature once you become aware of it and do not rely on its output.
Assistive technology. Nothing in these terms stops you from using assistive technology you need because of a disability or a health condition to take part in this course and its assessments, including technology that uses AI. That covers tools that read the material aloud or describe images and diagrams, present it in braille, magnify it or change how it looks, caption audio, turn your speech into text, complete or correct the spelling of words you are typing, or help you move around the page. A tool used this way may present the material to you and carry your own answers and your own words into the platform. It may not answer for you: it may not choose, generate, or suggest an answer, and it may not draft, outline, restructure, expand, or substantially rewrite a submission.
You do not need to ask before using a tool that only presents the material to you or turns your own speech into text. Tell us if you need something the platform has to change, such as more time, a different format, or a text description of a diagram, if you want to use a tool that suggests or corrects wording, or if a person will read or type for you, so that we can agree to the arrangement with you; a reader or typist agreed this way carries your words and keeps the material confidential. If you are unsure whether a tool is covered, ask; using it in good faith while you wait for our answer is not a breach.
Some assistive tools send what they read or hear to an outside service or computer system, which may include an AI model. You may use a tool like this if it is a closed system (meaning, it does not share what you enter with any outside company, does not save or store what you enter, and does not use what you enter to train any AI model). If your assistive tool offers a setting like this, such as an on-device mode or an edition provided by your organization that does not keep or learn from your content, and it works as well for you, please use it. If you are not sure whether a particular tool meets this standard, contact us first so we can approve it; Teknikos will not refuse an adjustment, delay it, or treat your use as a breach because the assistive technology you rely on works differently.
To ask for an adjustment or to check whether a tool is covered, contact the Teknikos accessibility contact at accessibility@teknikos.com. You do not have to go through your organization. Teknikos does not tell your organization that you asked or why, and nothing about an adjustment appears on your certificate, on the verification page, or in reports to your organization. The Certification Policy describes the process.
Other questions about the material go to your program contact at the organization that holds your seat.
Your assessment work is your own
The knowledge checks, the exam, and, where your course has one, the capstone brief must be answered or written by you and must reason from your own judgment. You may not use an AI system to answer an item or to draft, outline, structure, expand, or substantially edit a submission, and you may not submit work a model produced or reorganized on your behalf.
Working open-book means the course material and your own notes are available to you while you work. Please do not put your organization’s confidential information, or anything that identifies a customer or a colleague, into a submission: nothing in the assessment needs it, and what you submit is kept with your certification record.
The credential attests that a named person holds this level under their own judgment, which is what a customer is buying when they engage you. An answer or a submission a model produced cannot carry that attestation.
Assistive technology used as described under “AI tools and this material”, and any adjustment agreed with you, is part of how you work rather than a source of your answers, and using it is consistent with this section. What must be yours is the judgment: the answer you select, and the reasoning and content of your submission.
If these terms are breached
Teknikos may suspend your access while it investigates a suspected breach, and may suspend or revoke your access to the course and the materials space and remove you from the cohort, within the limits the Agreement sets, and pursue the remedies available under copyright, trade secret, and confidentiality and other applicable law, including a restraining order or an injunction. A check or exam result or a submission may be voided, and a certification suspended or revoked, only on the grounds and by the process in the Certification Policy, and a certificate is void only where the pass behind it was obtained by fraud or academic dishonesty. Where your course has a capstone, a capstone found to be generated rather than written is void rather than returned for resubmission, and your eligibility to continue in the program is reviewed.
Before Teknikos voids a result or a submission, or decides that a capstone was generated rather than written, a person at Teknikos reviews the evidence and you are told what is alleged and given the opportunity to respond. The output of an automated detection tool is never on its own a sufficient basis for that decision.
These terms survive your enrollment. Material you still hold when your access ends stays confidential, and the obligations above continue to apply to it.
Teknikos’ liability to you
The Platform, the curriculum, and assessments, and any certification are provided to you as they are and as available, and Teknikos gives you no warranty about them. To the fullest extent the law allows, Teknikos is not liable to you for indirect, consequential, or special loss, or for loss of profits, business, employment, or opportunity, arising from these terms, your use of the Platform, or any decision about your assessment or certification, and Teknikos’ total liability to you arising from these terms or your use of the platform will not exceed one hundred United States dollars (US $100.00). Nothing in these terms excludes or limits any liability that cannot be excluded or limited by law, including for death or personal injury caused by negligence or for fraud, and nothing in them affects your rights under the Learner Privacy Notice or applicable data protection law, or the review and appeal right the Certification Policy gives you. Your organization’s remedies are set out in its Agreement with Teknikos.
Governing law
These terms are governed by the law that governs the Agreement between your organization and Teknikos, and the courts identified in that Agreement have jurisdiction over any dispute between you and Teknikos under them, except that Teknikos may seek an injunction or other urgent/equitable relief in any court that has jurisdiction over you, and nothing in this paragraph takes away any protection that the law of the country where you live gives you and that cannot be excluded by agreement.
Using the platform
Your account is yours alone. Keep your credentials to yourself, sign in as yourself, and do not let anyone else act in your account or act in anyone else’s; a person who reads or types for you under an adjustment agreed with Teknikos carries your words and does not act in your place. Tell your program contact at once if you think your account has been used by someone else.
Use the platform as a learner. Do not probe, scan, scrape, or interfere with it, copy it in bulk by any automated means, or work around any access control, completion gate, or licensing control. The platform is provided as it is; it may be unavailable for maintenance or for reasons outside Teknikos’s control. Teknikos monitors use of the Platform and analyzes assessment work to protect the Platform’s security and the integrity of its assessments, as the Learner Privacy Notice describes, and may report a suspected breach of these terms, and the outcome and ground of any decision under the Certification Policy, to your organization. If you give Teknikos feedback about the Platform or the curriculum, Teknikos may use it without restriction or payment to you, including for commercial purposes.
Your submissions are your work, and Teknikos keeps them. Your knowledge exam responses, your recertification re-attestation responses, and your capstone brief are the record behind your certification: they are assessed by Teknikos and its authorized validators and kept for three (3) years after the attempt that earned or renewed your certification or, if later, until any appeal, challenge, or integrity review concerning it has concluded; submissions from attempts that did not lead to a certification or a recertification are kept for the period the Learner Privacy Notice states. The assessment instruments themselves — item banks, scenarios, rubrics, and scorer guides — are Teknikos’s and are never released to you.
Your data. Teknikos processes your name, your business email, and what you do on the platform under the Teknikos Learner Privacy Notice, which the platform presents beside these terms and which also explains the records Teknikos holds about you as a controller and how to exercise your rights. The platform uses the cookies it needs to work; where the law requires, it asks before setting any other. You agree that Teknikos may give you notices and records under these terms electronically, through the Platform or by email to your business address.
Teknikos may suspend or close your account for a breach of these terms, within the limits the Agreement sets. Your organization’s subscription governs how long your access lasts.
Acceptance
To continue, accept these terms where the platform presents them at sign-in. This records, against your account and with the version shown, that you have read and accepted the terms your organization agreed to and that they bind you as an Authorized User for as long as you hold access to this material and afterward as stated above. If you have a question about them, stop here and contact your program contact or Teknikos.
Summary
Read how Teknikos handles your personal data. You will need to acknowledge this notice to continue.
Full policy
This notice is for people who use the Teknikos learning platform through a subscription their organization holds. It says what Teknikos, Inc. (“Teknikos”, “we”) collects about you, why, who sees it, where it goes, how long we keep it, and what you can ask of us. Read it beside the Platform and Curriculum Terms of Use, which you accept when you first sign in, and the Certification Policy.
1. Who is responsible for your data
For your enrollment and course progress, your name, business email, and account identifiers, the sign-in and security logs of your use, and your support correspondence, your organization is the controller and Teknikos processes that data on its behalf, under a Data Processing Addendum with your organization. Questions about why your organization enrolled you, or requests to change what it holds about you, go first to your organization’s program contact.
For your assessment and certification records, Teknikos is an independent controller. These are your knowledge-check, exam, and recertification re-attestation responses and results, your capstone submission and its assessment, and the certification record: your name and business email, the certifications and certificates issued to you (the fact that you passed, when, against which curriculum release, and until when your certification runs), each recertification, and any decision about your certification under the Certification Policy’s integrity rules. They also include the record of your acceptance of the Terms of Use and of this notice being presented to you (which version, and when). Teknikos sets, runs, and scores the assessments and decides their results, and your organization cannot see this work. We keep these records after your organization’s subscription ends, so that a certificate you hold can be verified and so the program’s integrity can be defended. Requests about them come to us directly (Section 10).
Teknikos is also the controller for any request you make for an accessibility adjustment (Section 11).
If you are in the United States, the same split applies under state privacy law: for the data your organization is responsible for, your organization is the “business” and Teknikos is its “service provider” or “processor”; for assessment and certification records and adjustment requests, Teknikos is the business.
2. What we collect
This Section, together with Sections 3, 4, and 6, is our notice at collection for United States residents.
From your organization, when your seat is assigned: your first name, your last name, and your business email address. Nothing else is required to open a seat.
From your use of the platform: your account identifiers; sign-in and activity logs, including the time and the network address of each sign-in; course enrollment and progress; knowledge-check, exam, and recertification re-attestation responses and results, and, where a result is confirmed before it issues (Section 12), the record of who confirmed it and when; your capstone submissions and the assessment of them; the certifications and certificates issued to you and their release versions and dates; your acceptance of the Terms of Use and the record that this notice was presented to you, with the version and the time; and any support correspondence.
We do not ask for, and you should not enter, government identifiers, payment details, or other sensitive data. The one exception is information about a disability or health condition that you choose to give us when you ask for an adjustment (Section 11).
3. Why we use it
- To provide the course and the platform, run the assessments, and issue and maintain your certification.
- To keep the platform secure and the assessments honest: sign-in and security logs, which we process for your organization; integrity checks on submissions; and enforcement of the Terms of Use.
- To verify your credential, when you or someone you show it to asks whether it is valid.
- To report to your organization on progress and on the standing of your certification (see Section 4 for what it can and cannot see).
- To improve the platform and the assessments, using data combined and stripped of anything that identifies you or your organization. Once it no longer identifies you, it is not your personal data.
- To meet legal obligations and to establish, exercise, or defend legal claims.
Our legal bases. Where your organization is the controller, it decides the legal basis for its use of your data; its own privacy notice explains it. Where Teknikos is the controller, we rely on the following:
| What we do | Legal basis (UK GDPR / EU GDPR) |
|---|---|
| Run your assessments, including the module knowledge checks the platform scores and you can retake without limit; decide your capstone result and give effect to it by issuing the certification and certificate it earns; review a capstone or recertification result when you ask; and keep the certification record | Our legitimate interests in operating a credible certification program and in giving certificate holders a record they can rely on (Art. 6(1)(f)) |
| Verify your credential when someone checks it | Our legitimate interests, and yours, in allowing a credential to be verified (Art. 6(1)(f)) |
| Decide your knowledge exam result and your recertification re-attestation result automatically, and, where Section 12 requires it, have a person confirm it before it takes effect: by issuing the certification and certificate a passed exam earns, unlocking a capstone, or completing a course, as the course’s description states, and on a re-attestation by renewing the certification the result earns | Our legitimate interests in operating a credible certification program whose results are decided consistently, against the same key and passing bar for everyone (Art. 6(1)(f)). The result is decided automatically, unless Section 12 provides otherwise. Section 12 explains how, and how to have a person review it |
| Confirm results before they issue (where required under Section 12), and keep a record of who confirmed it and when | Our legitimate interests in results that are accurate and fair, and in one process for every learner wherever they are (Art. 6(1)(f)), and, where data protection law requires a person to be involved before a decision takes effect, compliance with a legal obligation (Art. 6(1)(c)). |
| Have a person at Teknikos review an automated knowledge exam or recertification re-attestation result when you ask, whether under data protection law or under the Certification Policy’s review procedure (Section 12); take into account anything you tell us; and correct the result, or reinstate your attempt, if the review finds a fault | Compliance with a legal obligation (Art. 6(1)(c)) where data protection law requires us to offer you human review of a result decided automatically (UK GDPR Art. 22C(2)); otherwise our legitimate interests in results that are accurate and fair (Art. 6(1)(f)) |
| Protect assessment integrity and enforce the Terms of Use | Our legitimate interests in the integrity of the program (Art. 6(1)(f)) |
| Report the standing of your certification to your organization, including the outcome and ground of any suspension, revocation, or void decision, and a suspected breach of the Terms of Use | Our legitimate interests, and your organization’s, in its knowing the standing of the certifications its seats carry (Art. 6(1)(f)) |
| Tell your organization that a security incident has affected records we hold as controller, and which categories of records and how many people were affected, without naming anyone | Our legitimate interests, and your organization’s, in its being able to respond to an incident affecting its people (Art. 6(1)(f)), and, where the law requires us to notify, compliance with a legal obligation (Art. 6(1)(c)) |
| Consider and make accessibility adjustments | Our legal obligations under equality law (Art. 6(1)(c)) and, for information about your health or disability, your explicit consent (Art. 9(2)(a)) (Section 11) |
| Maintain and improve the platform, the curriculum, and the assessments, including by analyzing results and submissions using data in de-identified or aggregated form wherever we can. | Our legitimate interests in maintaining a valid, current program (Art. 6(1)(f)) |
| Meet legal obligations | Compliance with a legal obligation (Art. 6(1)(c)) |
| Keep a record of your acceptance of the Terms of Use and of this notice being presented to you | Performance of our agreement with you under the Terms of Use (Art. 6(1)(b)), and our legitimate interests in being able to show which terms applied and which notice you were given (Art. 6(1)(f)) |
| Establish, exercise, or defend legal claims | Our legitimate interests (Art. 6(1)(f)) |
We have assessed these interests against your rights, and you can ask us for details of that assessment. Your first name, last name, and business email are needed to open your seat; without them you cannot use the platform. Some exam results are decided automatically (Section 12). We do not use your data for advertising and we do not sell it.
Your right to object. Where we rely on legitimate interests, you have the right to object at any time, on grounds relating to your particular situation, by contacting us (Section 10). We will stop unless we have compelling legitimate grounds that override your interests, or we need the data to establish, exercise, or defend legal claims.
4. Who sees it
Your organization’s seat administrator can see the roster, each learner’s status and progress, seat expiry dates, completion reports, and, while you hold one of your organization’s seats, the standing of your certification (current, in grace, or lapsed). If Teknikos suspects a breach of the Terms of Use, your organization may be told of the suspected breach. If your certification or access is suspended or revoked, or a certificate is voided, they are told the outcome and the reason, but not the evidence or your response. They cannot see your assessment responses, your scores or results, your capstone submission, learning summaries, or anything about an accessibility adjustment (an extension granted as an adjustment is not reflected in the dates they see), and they cannot act inside a course on your behalf.
Teknikos staff and authorized validators who run the platform, assess capstone work, confirm results where Section 12 of this Privacy Notice requires it, and provide support, all under confidentiality obligations. Validators see your submissions and the assessment of them. The person who confirms a result sees your answers, the answer key, your score and any technical fault recorded during your attempt; they are not given your progress, your activity, your organization, or anything about an adjustment. Validators do not see any information about a disability or health condition you have given us.
Our subprocessor. The platform runs on Microsoft Azure in the United States. Email the platform sends you is delivered through Azure Communication Services, and the mailboxes you can write to are on Microsoft 365. Both are Microsoft services in the United States. Microsoft processes data to host and deliver the service and for its related business operations under its data protection terms. You can ask us for the current list of subprocessors (Section 10), and we will update this notice when it changes (Section 14).
Verification. If you present your certificate to someone and they check it, the verification page confirms the holder, the certification, the release version, the issue date, and the certification’s standing. It shows nothing else about you.
We may also disclose your data, under confidentiality obligations, to our professional advisers and insurers, and to a successor if our business is sold or reorganized; where the law requires it; and where necessary to establish, exercise, or defend legal claims. Otherwise, we do not share your data with anyone. There is one exception: if there is a security incident affecting the records we hold as controller, we will tell your organization what happened and which categories of records were affected, so that it can act. We will not name the people affected, and we will not tell it your assessment work, your results, or the reason for an adjustment.
5. Where it goes
Your data is stored in the United States, in Microsoft Azure (East US), Azure Communication Services and Microsoft 365, and Microsoft and its subprocessors may access it from other countries to support and operate those services under Microsoft’s data protection terms.
Data your organization sends us — your name and business email. We use them on the platform for your organization, and we also put them on your certification record, which we control (Section 1). United Kingdom: your organization relies on the International Data Transfer Addendum to the European Commission’s Standard Contractual Clauses, issued by the Information Commissioner, in its Data Processing Addendum with us. European Economic Area: your organization relies on the European Commission’s Standard Contractual Clauses in that Data Processing Addendum. Other regions: the transfer is covered by the safeguards in that Data Processing Addendum. At the date of this notice, Microsoft has stated that it is certified to the EU-U.S. Data Privacy Framework and its UK Extension. You can ask us for a copy of the transfer terms (Section 10).
Data you give us directly — your assessment responses and results, your capstone submission, your certification record, and anything you send us to ask for an adjustment. Teknikos controls these records (Section 1) and holds them in the United States. Teknikos is itself subject to the UK GDPR and the EU GDPR as a controller when it processes these records about learners in the United Kingdom or the European Economic Area, and it protects them as this Section describes. Where Microsoft or one of its subprocessors reaches these records from another country to support the service, that access is covered by the transfer safeguards in Microsoft’s data protection terms, which include the European Commission’s Standard Contractual Clauses and the UK addendum to them. The Data Processing Addendum with your organization extends the safeguards above to the name and business email your organization gave us that we include in your certification record.
6. How long we keep it
Your organization’s data. Your enrollment and progress: for the subscription term and twelve (12) months after your seat expires, on your organization’s instruction, so you can resume if a new seat is bought; then deleted or returned within thirty (30) days as the Data Processing Addendum requires — your organization chooses which — and removed from backups within thirty (30) days after that. Until a backup copy is deleted we keep it secure and use it only to restore the service. Your account details and support correspondence: for the subscription term, then deleted or returned in the same way. Sign-in and activity logs the platform keeps: twelve (12) months. The sign-in records Microsoft keeps for the identity service are held for thirty (30) days, and the records of changes to the hosting itself for ninety (90) days.
The work behind a certification (your exam and re-attestation responses and your capstone submission): three (3) years after the attempt that earned or renewed your certification or, if later, until any appeal, challenge, or integrity review concerning that certification has concluded. What the certification record itself holds (your results, the learning summary for a capstone, the scoring record, and the record of anyone who confirmed a result before it issued): for as long as we keep the certification record, so that a certificate you hold can still be checked.
Assessment work from attempts that did not lead to a certification or a recertification: twelve (12) months after the end of the subscription term in which the attempt was made.
Certification records and your certificate (your name and business email, the fact that you passed, the certification or certificate of completion, the curriculum release, the dates, and any integrity decision): for as long as the certificate exists, so that it can be verified.
Your acceptance of the Terms of Use, and the record that this notice was presented to you (which version, and when): for as long as we keep your certification record. If you do not have one, we keep it for six (6) years after your access ends, so that we can show which version of the terms was presented to you if a question about your use of the material arises later.
Adjustment requests: as described in Section 11.
Where a claim, investigation, or integrity decision is pending, we keep the records relevant to it until it is resolved, and we may keep records for longer where the law requires.
7. Your rights
Depending on where you are, you may have rights to access your data, correct it, have it deleted, restrict or object to its processing, receive a copy in a portable form, and complain to a supervisory authority.
For enrollment and progress data, send your request to your organization’s program contact; we will help your organization respond. For assessment and certification records and adjustment requests, send it to us (Section 10) and we will respond within the period the applicable law sets. Some records cannot be deleted while they are needed to verify a certificate you hold or to defend the integrity of the program; we will tell you if that applies.
United Kingdom. Under the UK GDPR you may ask for access to, correction of, or deletion of your data, ask us to restrict its use, object to our use of it (Section 3), and receive a copy in a portable form where that right applies. If you have a concern about how we use your data, you can complain to us by email to privacy@teknikos.com; we will acknowledge your complaint within thirty (30) days and tell you the outcome. You also have the right to complain to the Information Commissioner’s Office (ico.org.uk).
European Economic Area and Switzerland. Under the EU GDPR, and in Switzerland under the Federal Act on Data Protection, you have the same rights as learners in the United Kingdom: access, correction, deletion, restriction, objection (Section 3), and a copy in a portable form where that right applies. Where a result is held for a person to confirm before it issues, Section 12 describes that step and how to ask for a further review. You can complain to us by email to privacy@teknikos.com; we will acknowledge your complaint within thirty (30) days and tell you the outcome. You also have the right to complain to the supervisory authority in the country where you live or work or where the matter arose, or, in Switzerland, to the Federal Data Protection and Information Commissioner.
Australia: you may complain to us first and then to the Office of the Australian Information Commissioner. Japan: you may request disclosure, correction, or cessation of use of retained personal data under the APPI.
United States. Depending on your state of residence, you may have rights under applicable state privacy law — for example, the California Consumer Privacy Act, as amended by the California Privacy Rights Act (together, “CCPA”), and comparable laws in other states — to know and access the categories and specific pieces of personal information we have collected about you (Section 2), correct it, delete it, receive it in a portable form, and opt out of its sale or sharing or its use for targeted advertising; we do not sell or share your personal data for cross-context behavioral advertising, so there is currently nothing to opt out of on that point, and we will honor an opt-out preference signal if that changes. Where you have given us sensitive personal information, such as information about a disability or health condition to request an adjustment (Section 11), you may direct us to limit its use to what is necessary to provide the adjustment, which is already the only use we make of it. We do not use automated decision-making that produces a legal or similarly significant effect about you without the human-review right described in Section 12. To exercise a right, contact us (Section 10); we will verify your request and respond within the period the applicable law sets. If we deny your request, you may appeal by contacting us at privacy@teknikos.com, and if we deny your appeal, you may complain to your state Attorney General or other applicable regulator. We will not discriminate against you for exercising these rights. You may use an authorized agent to make a request on your behalf, and we may ask for proof of the agent’s authority and verify your identity directly.
8. Cookies

9. Security
Teknikos maintains administrative, technical, and organizational safeguards appropriate to the risk, summarized in the Data Processing Addendum. Keep your own credentials private; your account is yours alone.
If a Personal Data Breach affects the assessment records, certification records, or adjustment requests for which Teknikos is the controller (Section 1), and the breach is likely to result in a high risk to your rights and freedoms, Teknikos will notify you directly without undue delay, consistent with Applicable Data Protection Law. For your enrollment and progress data, Teknikos notifies your organization, as controller, without undue delay, consistent with the breach-notification commitments in the Data Processing Addendum, and your organization is responsible for notifying you where the law requires it.

11. Adjustments and information about disability or health
If you ask for an adjustment, you may tell us about a disability or a health condition. That information is sensitive, and Teknikos handles it as follows.
Who is responsible. Teknikos is the controller for adjustment requests and the information in them. Your organization is not involved unless you choose to involve it.
What we use it for. Only to consider your request, put an agreed adjustment in place, and keep a record that we did. We ask only for what we need, and we do not need a diagnosis.
Our legal basis. We consider and make adjustments because equality law requires us to (Art. 6(1)(c)). Information about your health or a disability is a special category of data, so before we use it we ask you to confirm, in a sentence, that you agree to us using it to consider your request and put an adjustment in place. That confirmation is your explicit consent (Art. 9(2)(a)); asking for an adjustment is not by itself taken as your consent, and if you have not given the confirmation we will ask you for it. You can withdraw your consent at any time by writing to accessibility@teknikos.com. If you withdraw, we stop using the information, and we may then be unable to continue the adjustment. Withdrawing consent does not affect processing before you withdrew it or the record that an adjustment was agreed, which we keep as this Section describes.
Who sees it. Only the Teknikos staff who handle adjustments. Validators and platform administrators are told what the adjustment is, not why. We do not share it with your organization. It does not appear on your certificate, on the verification page, or in any report. It is never used in scoring your assessments, in integrity decisions, or in deciding whether to certify you.
How long we keep it. For as long as the adjustment is in use and for twelve (12) months afterward, in case you need it again. After that we delete the information about your condition and keep only a record of the adjustment that was agreed and when, for as long as we keep your certification record.
12. How your results are decided
Your results on knowledge exams and on recertification re-attestations are decided automatically. The platform compares the answers you select with an answer key that people at Teknikos wrote and checked, in which every item has one correct answer, and you pass if you reach the passing bar set in advance, which is the same for everyone. No other information about you is used — not your progress, not your activity, not your organization, and not any adjustment we have agreed with you. The result matters: depending on the course, an exam result decides whether you are certified, whether you can go on to the capstone, or whether the course is complete, and a re-attestation result decides whether your certification is renewed. You can ask for a person at Teknikos to review any of these results, to tell us your view and make your case, and to contest the result, at no charge, as described under “Human review” in the Certification Policy. Capstone briefs are the exception: they are assessed by people, not decided automatically. Where you take your assessment as an Authorized User who may be located in the European Economic Area or Switzerland (Commercial Schedule), no result issues until a person at Teknikos has reviewed and confirmed it, whether the result is a pass or not. That person checks the scoring against the key, whether any item was defective, and whether anything went wrong during the attempt, and has authority to correct the result or reinstate the attempt; the Certification Policy describes this step. Because a person meaningfully reviews and can change the result before it issues, the result is not a decision based solely on automated processing, so it falls outside Article 22(1) GDPR. The platform may also use automated tools to flag possible academic dishonesty in your assessment work. A flag is never itself a decision, and no result is voided and no certification is affected without human review, as the Terms of Use and the Certification Policy describe.
Before you start, and when your result issues. The exam and the re-attestation each tell you how they are scored before you start, and your result tells you your own score against the passing bar and how to ask for it to be reviewed. Certification is optional: if you would rather not have a result decided this way, do not start the assessment — you keep the course, its materials, and its updates either way.
13. Accessibility of this platform
